Foreclosure is when a lender seeks the forceful extinguishment of the ownership, possession, and lien rights of owners and other parties in a mortgaged property, so that the lender can sell the property at auction. These cases normally are filed when the borrower fails to keep up on mortgage payments. In Illinois, all foreclosures go through the courts, so they are known as judicial foreclosures.
JEP lawyers working on Foreclosure Defense provide services that may include:
- Foreclosure Defense: when a borrower files defenses and counterclaims that it may have to the foreclosure.
- Modifications: the lender and the borrower work out a deal to bring the mortgage current.
- Deed in Lieu: the borrower enters an agreement with the lender to hand the property over to the bank directly, in exchange for dropping the lawsuit.
- Consent Foreclosure: the bank and the borrower agree to have the court order that the lender has absolute title to the property secured by the mortgage, and that the borrower is released from any liability on the underlying debt.
